KERCEM A’ TOURS – TERMS & CONDITIONS
1. SCOPE
These Terms & Conditions apply to all bookings, quotations, and contracts issued by Kerċem A’ Tours (“the Organizer”) and form an integral part of any agreement with the Client.
2. BOOKING CONFIRMATION
Once the deposit has been paid, which is non-refundable, the booking is considered confirmed and you acknowledge that you have read and understood these terms and conditions. The Organizer will proceed to reserve the tour accordingly. The person making the booking accepts responsibility for all participants included and confirms that all travelers have read and accepted these terms and conditions. Names provided must match exactly those on the passport. Any corrections after ticket issuance may incur airline charges (€50–€115) plus a €50 administration fee.
3. PAYMENT TERMS
Payments may be made by cheque, cash, credit card, or bank transfer. For Adventures Tours, payment is made in three instalments: deposit at booking, second deposit 16 weeks before departure, and final balance 8 weeks before departure. For Destinations Tours, payment is made in two instalments: deposit at booking and final balance 8 weeks before departure. Deadlines will be communicated at confirmation. Bookings made within 8 weeks of departure require full payment at booking. Failure to meet payment deadlines will result in cancellation. The Organizer reserves the right to suspend or cancel services where payments are not received in accordance with agreed deadlines.
4. PRICE POLICY
Prices are based on rates at the time of publication and are per person. Child rates apply when sharing with two or three adults. Prices may change before confirmation. After deposit payment, prices will not be increased except due to exchange rates, taxes, fuel costs, or other external factors.
5. CANCELLATION BY THE CLIENT
The deposit is non-refundable except where cancellation occurs due to circumstances entitling the Client to a refund under applicable law, including but not limited to cancellation by the Organizer or extraordinary and unavoidable circumstances. Once full payment has been received (8 weeks before departure), the total amount is non-refundable. Special events and other pre-booked services may have separate cancellation terms.
6. CHANGES BY THE CLIENT
Changes are subject to availability and may incur fees, especially within 8 weeks prior to departure. Changes affecting occupancy or group size may result in price adjustments.
7. CHANGES OR CANCELLATION BY THE ORGANIZER
The Organizer may modify or cancel a tour due to operational reasons or insufficient participants. Clients will be informed at least 14 days prior to departure and offered a refund or alternative where possible.
8. SERVICE AND PROGRAMME INFORMATION
Travel descriptions are based on supplier information. Hotel check-in is from 3:00 PM and check-out by 9:00 AM. Unless otherwise stated, entrance fees, optional excursions, and local guides are not included. Only services listed under “Included in the Price” are covered. Programmes may change due to weather, maintenance, regulations, or other external factors.
9. TOUR LEADER AND CONDUCT
Tours are accompanied by a Maltese-speaking tour leader responsible for the programme. The tour leader is not required to perform duties outside the programme. Participants must behave responsibly; the Organizer may remove any participant without refund if necessary.
10. LIMITATION OF LIABILITY
Kerċem A’ Tours acts as an intermediary between Clients and third-party service providers. The Organizer shall not be liable for any loss, damage, delay, or inconvenience caused by circumstances beyond its control, including but not limited to acts of God, weather conditions, strikes, war, pandemics, or actions of third-party suppliers. The Organizer is not responsible for theft, loss, flight delays, or related consequences. However, nothing in this clause shall exclude or limit liability where such limitation is not permitted by applicable law.
11. SPECIAL REQUESTS
Special requests are subject to availability and cannot be guaranteed.
12. HEALTH AND TRAVEL REQUIREMENTS
Clients are responsible for passports, visas, and medical fitness to travel. Any costs arising from non- compliance are the Client’s responsibility.
13. TRAVEL INSURANCE
Clients are strongly advised to obtain comprehensive travel insurance. The Organizer is not responsible for costs arising from lack of insurance.
14. FORCE MAJEURE
The Organizer shall not be liable for events beyond its control, including but not limited to technical issues, transport disruptions, strikes, war, quarantine measures, adverse weather conditions, government restrictions, pandemics, or other unforeseen circumstances affecting travel arrangements.
15. DATA PROTECTION (GDPR)
Personal data provided by the Client shall be processed in accordance with GDPR (EU) 2016/679 solely for the purpose of fulfilling this agreement.
16. GOVERNING LAW & JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of Malta. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Maltese Courts.
17. EU PACKAGE TRAVEL COMPLIANCE
Where applicable, this agreement shall be subject to the provisions of the Package Travel and Linked Travel Arrangements Regulations (S.L. 409.19) and Directive (EU) 2015/2302. Nothing in this agreement shall limit the statutory rights of the traveller under applicable law.
